These terms govern your use of the Averello Studios website. They cover what you may do with the content here, what happens to material you send us, and the limits of what this website promises.
They do not govern a client engagement. Work the studio undertakes is defined by a separate written agreement, which takes precedence over anything on this page.
Acceptance of terms
By using this website you agree to these terms. If you do not agree with them, please do not use the site. We may update these terms as the site and the studio's services develop; the effective date above always reflects the current version, and continued use after a change means you accept the revised terms.
Use of this website
This website is provided for information about Averello Studios and to allow you to begin a conversation with us. You may read, print and share its pages for your own reference and for the purpose of evaluating the studio.
You agree not to:
- use the site unlawfully, or in a way that interferes with its operation or security;
- submit automated, deceptive or abusive form entries, or attempt to bypass the site's spam protections;
- scrape, mirror or systematically extract the site's content, or use it to train a machine-learning model, without our written permission;
- misrepresent your identity or your authority to act for an organisation when submitting an inquiry.
Intellectual property
The Averello Studios name, the Averello Studios marks, The Averello Process™, and the writing, photography, design, structure and code of this website are owned by Averello Studios or used with permission, and are protected by copyright, trademark and other applicable law.
Nothing on this site transfers any licence or right of use. In particular, you may not use our names or marks to imply endorsement or a working relationship, and you may not reproduce our written frameworks or methodology as your own. Quoting a short passage with clear attribution and a link to the source page is welcome.
Ownership of work created inside a client engagement is governed by that engagement's agreement, not by this page.
Client confidentiality and published work
Work shown on this site is published only where the client has approved its release, and some engagements are described without naming the client. Where a project is exploratory or illustrative rather than delivered, it is labelled as such. Absence of a client from this site should not be read as an absence of work, and presence should not be read as an endorsement of anything beyond the work described.
Enquiries and submitted materials
When you submit an inquiry you confirm that the information is accurate and that you are entitled to share it. Please send only what is needed to explain the opportunity, and do not send confidential, privileged or sensitive material through these forms — wait until a secure route is agreed. This website does not accept file uploads.
Submitting an inquiry does not create a client relationship, an engagement, or any obligation on either side. Nothing on this site is an offer, a quotation, or advice on which you should act without a written agreement. Where we hold a discovery call, it is a conversation about fit.
If you send us an unsolicited idea, concept or proposal, we cannot treat it as confidential and we may already be working on something similar. We are also under no obligation to review or respond to unsolicited material.
Information you submit is handled as described in our Privacy Policy.
The scope of our services
Averello Studios is a strategic experience design consultancy. We design brands, products and experiences, and we map where physical and printed touchpoints intersect with the customer journey. We do not act as a marketing agency, we do not run advertising, search or social media campaigns, we do not buy media, and we do not take over a client's marketing department. The services described on this site are capability descriptions; the commercial scope of any work is defined in a written agreement.
Third-party links and services
This site may link to websites and services we do not control, including a scheduling tool for discovery calls. Those links are provided for convenience. We are not responsible for the content, availability or privacy practices of third-party sites, and your use of them is governed by their own terms.
Disclaimers
This website and its content are provided “as is” and “as available”. While we take care to keep it accurate and current, we make no warranty that it is complete, error-free or uninterrupted, and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Content on this site is general in nature and is not professional, legal or financial advice.
Limitation of liability
To the fullest extent permitted by law, Averello Studios and its collaborators are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising out of your use of this website, even if we have been advised of the possibility. Where liability cannot be excluded, our total liability arising from your use of this website is limited to one hundred United States dollars. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Liability arising inside a client engagement is governed by that engagement's agreement.
Indemnity
You agree to indemnify and hold harmless Averello Studios and its collaborators against claims, losses and reasonable costs arising from your misuse of this website, your breach of these terms, or material you submit that you were not entitled to share.
Governing law and jurisdiction
These terms are governed by the laws of the state in which Averello Studios is organised and the applicable laws of the United States, without regard to conflict-of-laws rules. The courts of that state have exclusive jurisdiction over any dispute arising from this website. The studio's full legal entity name, registered address, notice procedures and any agreed dispute-resolution process are stated in our engagement agreements and are confirmed here on publication of our final legal terms. If any provision of these terms is held unenforceable, the remainder continues in effect.
